2. USE OF THE WEBSITE AND REGISTRATION

3. COPYRIGHT AND PRODUCT PRESENTATION
The contents of the website, including texts, photographs, graphics, databases and source code, are protected by copyright and other intellectual property rights regulations.
The website holds copyright to all of its own content (textual, visual and audio materials, databases and source code). Unauthorized copying of any part of the website without the permission of the copyright owner shall be considered an infringement of the rights of the respective party and shall be subject to legal action.
Product photographs are illustrative in nature and may not always correspond to the products that are the subject of the order in every detail. Vijci Kranjec specifically emphasizes that the visual appearance of a product shown in a photograph may not correspond to the actual appearance of the product, particularly due to the settings of the buyer's computer monitor, differences in the perception of colors as displayed on the buyer's screen, etc.
In the event of the above-mentioned discrepancy between the product shown in the photograph and the delivered product, this shall not constitute a defect in the product.
4. CONCLUSION OF THE SALES CONTRACT
The subject of the contract is the purchase of products selected through the online store vijci.live at the stated price and, where applicable, delivery costs and other costs communicated in advance.
The contract is concluded remotely by electronic means. Before the consumer submits an order involving an obligation to pay, the legally prescribed set of key pre-contractual information must be displayed to them clearly and prominently.
The button or similar function used to confirm an order must be labeled in such a way that it is unambiguously clear that the order entails an obligation to pay, in accordance with the Consumer Protection Act.
The contract shall be deemed concluded when the seller electronically confirms acceptance of the order, unless the consumer has been clearly informed otherwise during the ordering process in accordance with the law. The consumer shall receive confirmation of the concluded contract and the prescribed notices on a durable medium.
5. PRE-CONTRACTUAL INFORMATION FOR THE ONLINE STORE
Before concluding a distance contract, the seller shall provide the consumer, in a clear and comprehensible manner, with the information prescribed by Article 60 of the Consumer Protection Act, including in particular:
• the main characteristics of the goods or services;
• the name, registered office and contact details of the trader and the address for complaints if different from the registered office;
• the total retail price, delivery costs and other costs or the method of calculating them;
• the payment and delivery terms and the delivery period, as well as the method of handling consumer complaints;
• the conditions, deadline and procedure for exercising the right of withdrawal, the withdrawal form, and information on the withdrawal function available through the online interface;
• the seller's liability for material defects in the goods and its basic scope, including a minimum duration of two years;
• the existence and terms of a commercial guarantee, where applicable;
• where applicable, information on the manufacturer's free commercial durability guarantee for the entire goods lasting more than two years;
• where applicable, information on software updates, functionality, compatibility and interoperability of goods with digital elements;
• where applicable and where the manufacturer has made the data available to the trader, the repairability score or information on spare parts, repair instructions and repair restrictions;
• information on out-of-court resolution of consumer disputes.
If the manufacturer provides the consumer, at no additional cost, with a commercial durability guarantee for the entire goods lasting more than two years and makes this information available to the trader, the trader shall prominently display the prescribed harmonized label for such commercial guarantee.
6. RIGHT OF WITHDRAWAL
The consumer has the right, without giving any reason, to withdraw from a distance contract within 14 days, except in cases where the right of withdrawal is excluded by law.
In the case of contracts for the sale of goods, the 14-day period begins on the day on which the goods are delivered into the possession of the consumer or a third party designated by the consumer, other than the carrier. For other types of contracts, the period shall be calculated in accordance with the Consumer Protection Act.
The consumer may exercise the right of withdrawal by making an unequivocal statement addressed to the seller at Ulica grada Vukovara 3, Zagreb, or by email to prigovor@vijci.com, or by using the withdrawal function available through the online interface at vijci.live.
If the distance contract is concluded through an online interface, the seller must, during the withdrawal period, provide an easily visible and easily accessible function labeled with the words "withdraw from the contract" or another appropriate unequivocal expression. After submitting a statement through this function, the seller shall promptly provide confirmation of receipt on a durable medium, including the content of the statement and the date and time of submission.
The consumer must return or hand over the goods to the seller without undue delay and no later than 14 days from the day on which the consumer informed the seller of their decision to withdraw from the contract. The direct costs of returning the goods shall be borne by the consumer, unless the seller has agreed to bear them or has not previously informed the consumer that they are responsible for such costs.
The seller shall reimburse the consumer for all payments received from the consumer, including the cost of standard delivery, without undue delay and no later than within the statutory period. In the case of a sales contract, the seller may, where the statutory conditions are met, withhold reimbursement until the goods have been returned or until the consumer provides evidence that the goods have been sent back.
The consumer shall be liable only for any diminished value of the goods resulting from handling the goods beyond what is necessary to establish their nature, characteristics and functionality. Damage to or opening of the original packaging alone may not automatically result in a predetermined percentage reduction of the refund; any reduction must correspond to the actual diminished value of the goods.
Exceptions to the right of withdrawal shall apply exclusively in cases prescribed by the Consumer Protection Act, including, where the statutory conditions are met, certain fully performed services, goods made to the consumer's specifications, perishable goods, sealed goods that are unsuitable for return for health or hygiene reasons after opening, and other cases prescribed by law.
7. PRICES AND PAYMENT METHODS
All prices for consumers in the Republic of Croatia are stated in euros and include value added tax where applicable. Delivery costs and other additional costs shall be displayed to the consumer before the order is submitted.
For special forms of sales and advertising of price reductions, the rules of the Consumer Protection Act regarding the display of the previous or lowest price and other reference prices shall apply, depending on the type of sale.
One-time payment is possible using the cards listed on the website at the time of purchase. Installment payment is possible under the conditions clearly stated before the conclusion of the contract.
The seller does not store card details if payment processing is carried out through an authorized payment service provider. The method of processing and protecting data must correspond to the payment system actually used.
8. DELIVERY
Delivery methods, areas, prices and estimated delivery periods shall be displayed to the consumer before completion of the order. Unless otherwise agreed, the trader is obliged to fulfill the sales contract without undue delay and no later than 30 days from the conclusion of the contract.
9. WRITTEN COMPLAINTS, CLAIMS AND MATERIAL DEFECTS
The consumer may submit a written complaint at the seller's business premises, by post to Ulica grada 3, Zagreb, or by email to prigovor@vijci.com. The seller shall promptly acknowledge receipt of the complaint where required and shall respond to the written complaint in writing no later than 15 days from the date of receipt, clearly stating whether the complaint is accepted as justified.
Information on how to submit a written complaint must be clearly, visibly and legibly displayed at the business premises and on the website.
The seller shall be liable to the consumer for material defects in the goods in accordance with the Civil Obligations Act. The statutory liability for material defects in goods shall have a minimum duration of two years from the transfer of risk to the consumer, subject to the specific statutory rules on deadlines and burden of proof.
If the goods have a material defect, the consumer may, subject to the statutory conditions, request that the defect be remedied by repair or replacement, and, where the statutory conditions are met, a price reduction or termination of the contract. When exercising the right to remedy a defect, the seller shall inform the consumer of their right to choose between repair and replacement.
For consumer contracts concluded from 31 July 2026, if the defect is remedied by repairing the item, the period of liability for material defects shall be extended once by twelve months, in accordance with the Civil Obligations Act.
Repair or replacement shall be carried out free of charge, within a reasonable period and without significant inconvenience to the consumer, in accordance with the law. If the consumer terminates the contract due to a material defect where the statutory conditions are met, the seller shall bear the cost of returning the goods.
The seller may request a photograph of the damage or defect in order to process the complaint more quickly, but providing a photograph may not be imposed as a condition that would, contrary to the law, prevent the consumer from exercising their rights arising from liability for material defects.
If an expert assessment is required to determine the defect, the costs shall be advanced and ultimately borne in accordance with the Consumer Protection Act and the Civil Obligations Act.
10. COMMERCIAL GUARANTEE
Where issued, a commercial guarantee constitutes an additional obligation of the guarantor beyond the seller's statutory liability for material defects and does not affect the consumer's statutory rights.
The terms, duration and method of exercising a commercial guarantee shall be communicated to the consumer in accordance with the guarantee statement and applicable regulations. If the manufacturer provides a free commercial durability guarantee for the entire goods lasting more than two years and informs the trader thereof, the prescribed harmonized label shall also apply.
11. OUT-OF-COURT DISPUTE RESOLUTION
After first contacting the trader, the consumer may use the available mechanisms for out-of-court resolution of consumer disputes before the competent alternative dispute resolution bodies, in accordance with applicable regulations.
12. PERSONAL DATA PROTECTION
Customers' personal data shall be processed in accordance with the General Data Protection Regulation (GDPR), the Act on the Implementation of the General Data Protection Regulation and other applicable regulations. Detailed information on the data controller, purposes, legal bases, retention periods, data recipients and data subject rights must be contained in a separate, easily accessible Privacy Policy.
Provisions concerning the processing of data for marketing purposes must correspond to the actual legal bases for processing and must enable the easy withdrawal of consent where processing is based on consent.
13. PAYMENT SECURITY
The seller applies appropriate technical and organizational measures for data protection and payment security.
14. FINAL PROVISIONS
If any provision of these Terms is contrary to a mandatory legal provision, the corresponding statutory provision shall apply, while the remaining provisions of the Terms shall remain in force.
These Terms shall apply to contracts concluded after their publication on vijci.live.
